actions imposed by the Central
Coast Regional
Water Quality Control Board.
In 2007, a formal organization was created with the name Citizens for Clean Water to provide support and public information
concerning clean water, pollution control, and water management planning.

Outcome
Although
the County Board of Supervisors’ letter, the
May 10th meeting, and The Tribune
article seems to offer a ray of hope, CCW-PZLDF learned the following:
§ Individuals’ homes and
businesses still face a significant threat of enforcement.
§ The clock is ticking on
filing appeals for those with enforcement.
§ There was no stand down on
the first 45 enforcement actions.
§ There was no stand down for
orders issued on May 10th to the Moylans and Wilkersons.
§ The Board thinks that $30 per
day or $900 per month is better than $5,000 per day, but it did not
change the previous orders.
§ There are 25 or more clean up
and abatement orders called "settlements" that are in full
force, too.
§ All orders still contain reference
to the 218 vote that was used to force people to pass the assessment.
§ Property owners in the
Prohibition Zone are liable for fines all the way back to 1988, in
addition to prior orders.
§ That retroactive fine applies
to the Los Osos CSD and to ALL the property in Los Osos Prohibition Zone.
§ The RWQCB Executive Director
or Harvey Packard has the power to issue all new orders without a Board
involvement or a meeting.

A Superior Court judge Wednesday ruled that some Los Osos residents can
continue their high-stakes legal battle against the state. Judge Barry
LaBarbera ruled that residents’ lawsuit against the state Regional Water
Quality Control Board could proceed. He denied a motion filed by the
state Attorney General’s Office that said the case was weak and should be
thrown out of court.

Enforcement
Petition Information
This is the process to
get the case to court. It is not a hearing of the evidence or the actual
case, but an effort by the State to deny the petitioners the very right
to the appeal and to present the evidence against the State. The State
Attorney General, on behalf of the Central Coast Regional Water Board, is
trying to deny the parties the rights to present its case.
PZLDF attorney, Shaunna
Sullivan, Esq., prepared the issues in a revised (4th petition) that
put forth for reasons the Court should hear the case. This kind of preliminary
fight was expected, since the agencies of the State employ this method to
deny justice and to seek to “bleed” the (citizen) petitioners before
getting the case before a judge for the actual hearing.
CCW-PZLDF has the evidence
to prove the case, and we encourage you to read through the petitions
linked below.
CCW-PZLDF is
also listing all the documents that are missing from
administrative record that was prepared by the Regional Water
Board. (at a cost to the Petitioners of approximately $5000.00.
